HC orders MIDC to construct common effluent treatment plant

NASHIK: The Bombay High Court (HC) on Tuesday ordered the Maharashtra Industrial Development Corporation (MIDC) to submit an affidavit by September 30 on when and how it will be constructing the common effluent treatment plant (ETP) in Nashik. The divisional bench comprising Abhay Oka and Gautam Patel was hearing the petition filed by Godavakri Gatarikaran Virodhi Manch against government officials for the pollution of the Godavari river.

The HC said the MIDC was shrugging off its responsibility and had no right to point fingers at others for the river's pollution. The Maharashtra Pollution Control Board (MPCB) has also been asked to present a report by September 30 on what action it has taken on erring industries.

"These agencies have been asked to submit their affidavits during the next hearing on September 30. The state government has also been asked to appoint four police sub-inspectors and 30 policemen within one month to be posted along the riverbank to check on river polluting offences," Pravarthak Pathak, lawyer of the petitioners, told TOI. "The NMC submitted an affidavit to the HC saying that by May 31, 2014, it will be acquiring land at Gangapur village and Pimpalgaon Khamb for the proposed sewage treatment plants (STPs) and will be constructing them after that," he said.

Pathak said that the HC also asked the NMC to strictly follow the MPCB guidelines for STPs. "The biochemical oxygen demand (BOD) of the water being released from the STPs was initially set at 30 by the MPCB. After the recommendations of the National Environmental Engineering Research Institute (NEERI), the MPCB reduced it to below 10. Now, all STPs have to be modified. The class A2 of the river should be maintained, the HC said," Pathak added.
